Motorcycle Laws In California

California motorcycle law under California Vehicle Code (CVC) 27803 states:

  • A motorcycle driver and any passenger must wear a safety helmet when riding on a motorcycle, motor-driven cycle or motorized bicycle.
  • It is unlawful to operate a motorcycle, motor-driven cycle or motorized bicycle if the driver or any passenger is not wearing a safety helmet.
  • It is unlawful to ride as a passenger on a motorcycle, motor-driven cycle or motorized bicycle if the driver or any passenger is not wearing a safety helmet as required.

Though motorcycle helmets may not make much of a difference in the most catastrophic or fatal motorcycle accidents, they can go a long way in preventing traumatic brain injury and brain damage in lesser crashes.

Even a minor accident can knock a motorcyclist off their bike and onto the ground, leading to a serious head or neck injury. In such cases, wearing a motorcycle helmet can mitigate these injuries or even prevent brain injuries such as concussions.

Currently, California is the only state to legally allow lane splitting, the act of riding a motorcycle between lanes of traffic going in the same direction. This allows motorcycle riders to bypass traffic and reduces air pollution.
