        Common Causes of Car Accidents

Car accidents happen every day, and sadly even the most experienced drivers can be caught in a serious wreck. When a motor vehicle crash is caused by the negligence of someone else, the victims have a legal right to bring a lawsuit against the at-fault party. In California, the statute of limitations for filing a car accident claim is two years.

Though it would be impossible to list every possible factor that can lead to a car wreck, some of the most common causes include:

        • Distracted driving
        • Driving under the influence
        • Speeding
        • Reckless driving
        • Bad weather conditions
        • Poorly designed roads
        • Poorly maintained roads
        • Vehicle defects

What Should I Do After a Car Accident?

If you or a member of your family is involved in an car or truck accident, there is certain information that you should obtain at the scene if at all possible.

You should collect the names, addresses, phone numbers, driver’s license numbers, and insurance information of all parties involved, as well as the names, addresses, and phone numbers of any eyewitnesses to the accident.

You should also photograph the damage to the vehicles, as well as any accident debris or other physical evidence like skid marks. If you don’t have a camera with you, then be sure to photograph the damage to your vehicle and the accident scene as soon as possible in the days following the accident to preserve any important physical evidence.

Collecting evidence on your own is especially critical in case the other driver and their insurance carrier later dispute liability for the accident. However, you should also contact the police to the scene so they can file an accident report and conduct their own investigation.

After you have had an opportunity to seek appropriate medical care for your injuries, you should contact an experienced personal injury attorney who specializes in car and motorcycle accidents so you can learn what your legal rights are, and get an expert legal evaluation of the merits of your case and its potential monetary value.

Is It Worth Getting An Attorney After A Car Accident?

Depending on the severity of your accident, the scope of your insurance coverage, and how compliant the at-fault driver is, you may not actually need an attorney. However, consulting with a car accident lawyer after your accident is usually free and can help maximize the compensation you receive while you focus on recovering.

Therefore, even if you don’t think you need to hire an attorney following your motor vehicle accident, we highly recommend seeking the advice of one. You may be able to uncover something helpful or insightful about your situation you weren’t aware of.

If you do decide to work with one, a car accident attorney can be an invaluable ally. An experienced lawyer will immediately take steps to collect evidence, consult with health experts and accident reconstructionists, file legal paperwork, build your case, and maximize your compensation.

This can be especially helpful if you are suffering from serious injuries or aren’t very familiar with legal language and procedures.

How Do I Pay My Medical Bills After a Car Accident?

Following an accident, it is extremely important that you receive competent medical attention for your injuries as soon as possible. Depending on the severity of your injuries, however, that treatment can be expensive. So how are you going to pay for it?

If you are in a car accident and carry optional medical payments coverage, also known as Med Pay, under your automobile insurance policy, then normally your own insurance carrier will pay all of your reasonable and necessary medical bills up to the limits of your medical payments coverage.

This same Med Pay coverage would also cover all of the medical bills of any passengers in your car who are injured in the same accident again up to limits of your medical payments coverage for each person who was injured.

On the other hand, if you had no medical payments coverage under your automobile policy, but had HMO coverage, your HMO would normally pay your medical bills instead.

In both cases above, however, most car insurance carriers and HMOs will usually seek reimbursement for the total amount they paid against your bills out of any monetary compensation you may later receive from settling your case. This is called a lien.

What most people don’t realize is that an experienced personal injury attorney who specializes in this field can usually negotiate these liens down by as much as 30% to 40%, thereby saving the client a substantial amount of money when the main case against the negligent party settles, and the liens then have to be paid back.
